Terms of service

1. Who you're dealing with

Daysprint is operated by Dan Sutherland (ABN 73 119 880 342), based in Melbourne, Australia. These terms apply to every project unless we agree otherwise in writing.

2. Quotes and scope

Every project starts with a written fixed quote describing exactly what will be delivered, the price, and the ship date. The quote is the scope - if it isn't in the quote, it isn't in the project.

Quotes are valid for 7 days. Changes requested after acceptance are welcome but are quoted separately; they never silently expand the original scope or price.

3. Payment

50% of the quoted price is payable upfront to lock the build slot; the balance is payable on delivery. Prices are in USD and exclude GST - GST is added for Australian clients.

If you cancel before the build starts, the deposit is refunded in full. Once the build has started, the deposit is non-refundable, reflecting the work and the reserved slot.

4. Delivery, revisions and warranty

The ship date runs from when the deposit is received and any materials needed from you (content, access, credentials) are provided. Delays in providing materials extend the ship date by the same amount.

One round of revisions within the quoted scope is included on build packages; Rescue Fix engagements are single-fix, with no revision round. Bugs in delivered work are fixed free of charge for 14 days after handover. For Rescue Fix engagements: where diagnosis shows the issue is bigger than a single fix, you receive the written diagnosis and a fixed quote for the full repair, with the Rescue Fix fee you have paid credited against that quote.

5. Ownership

On final payment, you own the deliverables: full source code and intellectual property in the work created for your project transfer to you. Code is delivered to your own repositories and deployed to your own accounts wherever practical.

Open-source components keep their own licences, and generic tooling, templates and know-how that pre-date your project or are of general application remain mine - licensed to you perpetually and free for use in the deliverables.

6. Your responsibilities

You're responsible for the accuracy of content you supply, for having the rights to any materials you provide, for maintaining your own accounts with third-party services (hosting, domains, APIs) and their costs, and for backups of your own systems and data.

Timely feedback keeps fixed ship dates fixed - where a project stalls for more than 30 days waiting on you, it may be treated as delivered as-is, with the balance payable.

7. Liability

Services are provided with due care and skill. To the maximum extent permitted by law, total liability arising out of or in connection with a project is capped at the fees actually paid for that project, and neither party is liable to the other for indirect or consequential loss, including lost profits, revenue or data.

Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including consumer guarantees under the Australian Consumer Law. Where liability for breach of such a guarantee can be limited, it is limited to re-supply of the services or payment of the cost of re-supply.

8. Confidentiality

Anything non-public you share for a project - code, credentials, business information - is used only to deliver the project and isn't shared with anyone else. Completed public work may be referenced in a portfolio unless you ask otherwise.

9. General

These terms are governed by the laws of Victoria, Australia. If any part of these terms turns out to be unenforceable, the rest still stands. Questions: hello@daysprint.dev.
